Realizing Genius
PARENT/STUDENT AGREEMENT AND RELEASE
2021-2022
I am the parent and/or legal guardian of the student identified herein. I am legally authorized to enter into this agreement on behalf of the student as well as on my own behalf. This agreement is in reference to participation in any online educational service offered by Heidi Christianson DBA Realizing Genius (hereafter referred to as Realizing Genius or Realizing Genius Academy), an organization that connects homeschooling parents and students with experienced service providers (hereafter referred to as instructors.)
- Enrolling in a Classes. In order to attend classes at Realizing Genius, you must officially enroll through our membership website so that your student is on the instructor’s official class roster. Only enrolled students will be allowed onto the online class platform. If you need assistance with enrollment, please email us at info@realizinggenius.com. Enrollment is not complete until the Realizing Genius Parent/Student Agreement and Release is signed by you, the parent/guardian, and the student. Classes fill on a first come first serve basis. Please don’t delay in enrolling in classes as it could give an instructor the impression of low enrollment and may trigger a class cancellation. Once you enroll in a class, you will be given access to the private membership website. The Instructors have also been asked to reach out to you directly.
CALIFORNIA ONLY: A purchase order from your charter does not constitute enrollment. - Paying for Classes. Payment for all classes is done on the Realizing Genius Academy website. Please refer to instructions there.
CALIFORNIA ONLY: If using charter funds to pay for any class tuition, you will need to use your school’s procedure. If Realizing Genius is not currently a vendor for your school, please reach out to info@realizinggenius.com with your school information and we will start the process to become a vendor. - Withdrawing from a Class. If you withdraw from a class, please contact the instructor and Realizing Genius immediately to let us know. Some of our classes fill up quickly, and instructors need to be able to fill the seats. The withdrawal policy for semester classes is that after one class you feel it will not be a good fit for your student, they may be withdrawn with a full refund. At the 3rd week students may be withdrawn for a 75% refund. Withdrawal at the 4th or 5th weeks will get a 50% refund. After the 5th week there will be no refunds. Shorter classes will have different refund policies depending on the instructor. Individual instructors may have additional requirements.
- If a Class is Cancelled. Realizing Genius and the instructors work hard to make sure that no class is cancelled but sometimes circumstances are unavoidable. If a class has low enrollment an instructor may contact you directly to discuss options for keeping the class up and running on the schedule. If an agreement cannot be made, please contact the Realizing Genius about any fees or charter purchase orders that have been processed for the class.
STANDARDS OF BEHAVIOR
- All parents and students are expected to behave in a respectful manner while attending classes through the Realizing Genius Academy platform.
- Students are also expected to behave in a kind and courteous manner towards everyone enrolled. Parents are responsible to ensure that students are adhering to the standards of behavior at all times. Breaches of the standards will be handled directly between Realizing Genius, the instructor, and the parent on a case-by-case basis.
- Bullying will not be tolerated. Profanity is prohibited. Depending on the severity of the incident, the instructor may prohibit the student from further participation in the class and withdrawn from the class for the rest of the day. Realizing Genius may also withdraw the student form all Realizing Genius classes. If a forced withdrawal occurs, the student is not entitled to a refund of any registration or class fees.
- Dress Code Policy: Students are to make good choices when selecting their clothing to wear to classes. Inappropriate attire, anything excessively short, immodest or improperly worn, will result in a phone call to the parent to bring different clothing for the student to change into.
CLASSROOM RULES
The following are generally accepted rules unless modified by the instructor:
- Regularly Attend Classes: Regular attendance in these courses is crucial to preserve the learning environment for all students. All Realizing Genius Academy classes are recorded in case students are unable to attend classes, but the classes are designed to be dynamic with opportunities to engage with other students. If students are unable to attend it effects the entire class.
- Arrive to Class Prepared: Students are expected to come to class prepared. Students in classes where paper and pencil work is done should have adequate note paper, pencils and erasers close to their computer during class. Instructors in core classes often provide regular homework which they post on the membership site. Please be sure to have your student complete this work in the schedule provided by your instructor. Please check with individual instructors as to the expectations and additional supplies required for each specific class.
- Be Respectful to Instructors and Students in class: The instructor sets the rules of the class and will provide instructions in class and on the membership website for any rules which extend beyond what is written here. Students are expected to come to class ready to learn and observe proper classroom behavior. Speaking out of turn or being disruptive in class will not be tolerated. Students enrolled in core classes are also expected to make all efforts to complete homework assignments on time. Doing this ensures that the curriculum can flow and other student’s efforts are respected. If there are any issues in the classroom, please speak with the Instructor first to develop an appropriate plan of action. Cell phone use during class is generally prohibited. Unless required for a classroom activity, cell phones should be turned off during class time. Students should also refrain from using headphones in the classroom.
DISCIPLINARY PROCEDURES
The following are generally accepted rules unless modified by the instructor. However, Realizing Genius reserves the right to dismiss any student for inappropriate behavior.
- Verbal warning: For the first infraction, the student will receive a verbal warning.
- Parent Supervision: If behavior does not improve, an instructor may require parent attendance for a child to participate in class.
- Student Dismissal: If a student continues to compromise the learning environment for others by not adhering to our behavior policy, he/she will be withdrawn from the class by the instructor. No refunds for classes or registration will be given if a student is asked to leave.
STUDENT LIABILITY AND MEDIA RELEASE
- General Release. I acknowledge that I remain the sole party responsible for the named student’s actions, activities, supervision, safety, insurance, and financial needs. I understand that the instructors at Realizing Genius are not the employees or independent contractors of Realizing Genius. Even though this student will enroll in academic classes at Realizing Genius, I am solely responsible for this student. I am utilizing the assistance of Realizing Genius for my convenience, and any activity the student engages in will be under my control and with my knowledge and consent. I, my spouse, legal guardian, or a designated responsible adult will monitor my child during all Realizing Genius classes or related activities. I accept the responsibility to take whatever action or precaution is necessary to protect my student, to supervise any activity undertaken in connection with , Realizing Genius and to withdraw my student from any activity or situation that I deem unsafe.
On behalf of myself and this student, I hereby waive and release and hold harmless Realizing Genius and the service providers/instructors from any liability, any action or cause of action associated with this student’s participation or association with Realizing Genius related activity, and I hereby indemnify and agree to hold the released parties harmless from any liability or legal action which may be brought by or on behalf of myself, this student or any other related party, arising from any activity of Realizing Genius. - Media Release. I hereby give consent to allow Heidi Christianson, Realizing Genius, and its assignees, to use, in perpetuity and without compensation, my image, likeness or that of this student to promote classes offered at or promoted by Realizing Genius. Your name or this student’s name(s) will not be publicized unless permission is granted by you. The undersigned, individually and also as the parent or guardian of the minor(s), do hereby consent to, and agree to be bound by, this media release.
I also understand that all classes are recorded and will be available to other students on the membership website. - Additional Responsibilities. In participating in classes promoted by Realizing Genius and offered by Realizing Genius, I understand that since I am the participating parent, guardian and/or legal responsible person in charge of this student’s education, I am responsible and acknowledge that:
- I shall monitor this student’s participation in all classes.
- I shall be fully knowledgeable and aware of class activities and materials being taught.
- I ensure that this student’s appearance is appropriate and does not distract from the educational environment.
- I ensure that this student is respectful of any rules and regulations during Realizing Genius classes or events.
- I ensure that this student understands and respects rules for orderly conduct, and that he/she will treat teachers, students, and other family members with kindness and respect.
- I understand that conduct rules may be posted and changed from time to time.
- I understand that electronic devices are only to be used for educational purposes and not for gaming or music because such uses distract from the educational purpose of the classes.
- I understand that if we (student/parent/guardian) are warned about refraining from specific behavior or fail to prepare for all classes, or treat any person disrespectfully, we may be asked to cease attendance at Realizing Genius.
- In the event that we are asked to cease attendance of classes on the Realizing Genius online Venue, no refund for any paid services will be warranted.
- Severability. If any provision of the Liability Release or Media Release or Additional Responsibilities is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this agreement shall remain in full force and effect. By signing and checking the box below, I confirm that I have read the Liability, Media, Additional Responsibility releases and I agree to the terms and conditions of these provisions.
- Venue This Agreement and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of California including all matters of construction, validity, performance, and enforcement and without giving effect to the principles of conflict of laws. Any action brought by any party hereto shall be brought in Riverside County, California.
- Waiver of Jury Trial EACH OF THE PARTIES HERETO HEREBY IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREBY. If the parties cannot agree to an arbitrator, they shall use the services of Riverside County, California.
The parties agree that this agreement may be electronically signed. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility. You also understand that you are not required to sign this agreement electronically but may request a copy of the agreement to hand sign and send back to Realizing Genius which will require Realizing Genius to review and initial the agreement before it is accepted as binding. The handwritten signature process will cause some delay, and placement in any class cannot be reserved for the student during the delay process.
By checking the box below, however, you agree that your electronic signature and/or the checked box is sufficient to show your intent to agree to all the terms of this agreement without further delay.
